Mediation Approach
My approach to mediation is shaped by my personality and professional experience, which is to say, I am a good listener who is thoughtful and direct in my communications with parties and their counsel. I will tell you the good news and the bad news and I will ask you questions until I know that I understand exactly what your concerns and expectations are. I will work tenaciously to achieve resolution, and will offer guidance on demand and counter-offer moves, incorporating principles of game theory, behavioral economics and psychology of decision-making as needed. One thing I can promise you is that the day will not end promptly at 2:30 with a mediator's proposal (unless that is what you ask for). I will continue shuttle diplomacy as long as necessary, including on subsequent days if we do not reach resolution on the date of the mediation session.
